TERMS & CONDITIONS
This Agreement is by and between ” DM Creation Photography” and “Client” which includes the Client’s employees and representatives. Client agrees that it has the legal authority to enter into this Agreement on behalf of its employer, company or organization. Photographer’s relationship with Client is that of an independent contractor.
“Image(s)” means all visual representations furnished to Client by Photographer, whether captured, delivered, or stored, in photographic, magnetic, optical, electronic, digital, analog, or any other, media.
COPYRIGHTS
The Agency retains the entire copyright on the Photographs, Films and other works at all times, throughout the world.
DISPLAY
The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, social media, brochures, magazine articles, websites, sample albums etc.
COVERAGE AND REPRODUCTION
- Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client’s requirements.Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the client’s requirements.
- For a booking involving a ceremony at the church, temple, religious places or at certain venues, the photographer’s movements are sometimes restricted by the official in charge(venue/place). The area from which the photographer is able to cover the ceremony may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
- Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
- The photographer is not liable for publishing any video/audio format deliverable on the internet.
- Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
REQUESTED PHOTOS
While the Photographer will make every reasonable effort to take photos specifically requested by Client, Client understands that this is an uncontrolled event and that due to the uncertainties of the weather, available light, time restrictions, and willingness of subjects, the Photographer cannot possibly guarantee that ALL requested photos will be taken.
PAYMENT POLICY
- 30% advance to be paid on the date of booking, 50% to be paid on the first event date, 20% to be paid on the delivery time.
- Payment structure will be shared to the client at the time of booking.
- Once the advance is paid it will be non-refunded.
ON THE DAY
- The photographer will be the sole professional photographer at the venues specified. The photographer does however positively encourage family, friends and other guests to take photographs throughout the day.
- The photographer will not take photos during his breakfast or lunch or dinner time and will use this time to take a break. In case if client need’s any special photos, please update the photographer before his food time.
- The photographer will not be responsible for the chromatic reflections or shades.
- It is the client’s responsibility to arrange power supply for our lights at the venue.
- Travelling, Accommodation, fooding and local conveyance shall be provided by the client .
FAILURE TO PERFORM
We wedding photographer shall have no liability to you under this Agreement if we are prevented from carrying out the Photo Services by,
- (a) The bride and groom or wedding party not being on time and/or the church, the reception, engagement or the place of the wedding having photography restrictions.
- (b) Any acts, events, omissions or accidents beyond our reasonable control, including strikes, failure of a utility service or transport network or compliance with any law or governmental order.
- (c) Photographer will try to attempt to procure the services of another professional photographer to fulfil his obligations.
CANCELLATIONS OR POSTPONEMENT
- We inform to our clients that we have no cancellation policy. But if the client wants to cancel the event from his/her side following conditions are applied.
- Once the advance is paid it will be non refunded from the date of advance.
- When Client, its assigns, postpones or cancels an assignment, or is unable to reschedule said assignment to a time and date agreeable to Photographer, Client will be responsible for payment of any and all expenses up to the time of postponement or cancellation because we have booked the team before and any offer or discount given before is not applicable in cancellation or postponement.
- Thirty percent(30%) of fees for postponement, or cancellation, from the scheduled time of booking and after 24 hours all amount is non-refundable
- Eighty percent(80%) of fees for postponement, or cancellation, after Photographers, has departed for the location or completed/ started first event .
- Once the booking is confirmed and the event date is fixed, the date will be reserved exclusively for the client. After confirmation, the client will not be allowed to change or shift the date under any circumstances. If the client wishes to change the event date, additional charges will apply. The charges will be determined based on the package selected at the time of booking and the new date requested.
- Event cancellations are strictly not permitted.If the client cancels the event for any reason (personal, professional, or otherwise), all advance and booking payments made will be non-refundable.In the event of cancellation, DM Creation Photography will not be liable to provide any services or return any portion of the payment.
DELIVERY
- Photo album & edited Video will be delivered within 45days ( After photo selection)
- For other delivery dates, process of delivery, selection and samples contact us before the final payment.
- If the client wants to verify his/her edited output, it’s only possible in our office. No online modes are not available.
- 3 days of the time period to inform the manager for re-editing(extra charges apply) the final output video from the final receiving date.
- We will delete all the raw and post-production edited data in between 7 days after the data ( Album & Edited Video ) delivery to the client
- The client most collected his/her output from the office. Home delivery services are not available.
- Output deliver by the courier(Blue dart Only) is available (courier charges apply). But we are not responsible for any damage by courier Service.
- Maximum 4 months of the time period from the last event date to collect all the raw/post-production outputs by the client.
- If the client not collected his/her raw edited output in between 4 months he/she must pay the total amount to save his/her all data.(Maximun 1 year).
- In case of any data loss(raw data) after 4 months of time period complete. DM Creation Photography will not be responsible for that.
- If the client want any raw videos, teaser, reels, etc before the delivery period, he/she must be clear full payment.
- After collected edited/raw output by the clients from DM Creation Photography we will delete all the data in between 3 days and unable to provide raw and edited data after 3 days.
- Our invitation video packages are priced from Rs. 5000 up to Rs. 1,50,000 Per One Invitation Video.
The variation in pricing depends on the low quality to high-quality, level of creativity, customization, and production value involved. Higher-priced packages include enhanced visuals, advanced editing, premium concepts, and more personalized creative execution. - Album+ Edited video ( Reals, Highlights, Full video etc ) total Charges = 10k Deducted from total amount. If the post-production is not done by us. it is only applicable in combo packages of excellent and professional packages or single side 3 days event or more than that . and not applicable in indivisual event.
- Album+ Edited video ( Reals, Highlights, Full video etc ) total Charges = 2k to 5k maximum Deducted from total amount. If the post-production is not done by us. it is only applicable in basic and medium packages single side/both side and applicable in indivisual event
- In combine events,one combine(Post Production) is possible. Clint must pay extra charges(i.e- 10k to more) according to there requirment of the event for individual editing.
- After the song slection in excel sheet. it can not be change. if the client want to change the song extra charges to be paid. This charges is applied in all songs changes process(Song choose by the team & client want to change)
DELIVERABLES
1. The client selected an Invitation video/Template from the project Provided by DM Creation Photography which is absolutely free. ( Project Design & music can not be changed).
2. If the client wants to changes in Invitation video/Template’s project design, music and demands for outside Project additional charges will be paid by the client.
3. Pictures selection for album printing to be completed and shared with us via any media within 7days from the date of total event completed.
4. Further deliveries will be delayed in case of delayed response from the client
5. Once the final delivery is confirmed and completed, No extra requirements will be served without payment.
6. Charges will be applicable as per re-work requirement and projects’ scale.
HOLIDAYS
The post production services are not available on sunday and public holidays.
DIGITAL FILES
- Organization/Photographer cannot guarantee the availability of digital files beyond the date of first delivery to Client or beyond 30 days from the date of total events completed.
- A photographer is committed to providing high-quality services. Unless otherwise specified, Photographer may deliver, and Client agrees to accept, the Image(s) encoded in an industry-standard data format that Photographer may select, at a resolution that Photographer determines will be suitable to the subject matter of the Image(s) and the reproduction technology and use(s) for which the Image(s) is licensed.
- If we should have shoot any clients’ weddings, Haldi & mehndi, preweddings, Engagements, Birthdays, Maternity, or Anniversary, DM Creation has the rides to upload pictures and videos to social media and apply photo ads, Instagram, Facebook, YouTube, etc.
- If the Client denied his/her photographs or videos can not be used for our site, Client must inform DM Creation Photography in a written email & whatsapp.
- Verbal requests or post-event objections for upload in social media(Instagram, Facebook, YouTube, ads, website, Twitter) will not be accepted.
HELPING HAND
1. Please arrange someone from your family who can help our team to know what is important and what needs to be covered regarding this during the events. We won’t be responsible or questioned later about any event being missed, because unless we know something what was important, it’s difficult to know. So, someone close to the bride or groom can help the team with this flow.
2. The photographs and Videos must be captured under the guidance and instructions of the helping Hand person. who must be crushed checked and approved the photographs and videos at the time of event.
3. The Helping hand person must be a guide/directing the Photography and videography team during the event. All media content (Photos/videos) will be taken based on Helping hand person approvals.
4. Once the event is concluded no questions; claims of disputes shall be raised by either the client or the helping hand person regarding any missing or on recorded photos or videos. The photographers, videographers & Management team shall not be held label for any such omissions
5. If the photography or videography team doesn’t cooperate with the assigned Helping Hand person during the ongoing event, we ask that you please report to the management team as soon as possible on the ongoing event. The management team will promptly address the matter, take appropriate action against the photography team, and work to resolve the issue on-site to ensure the smooth continuation of the event.
6. Once our team reaches the shooting location, if you face any issues related to photography and videography, please inform our office immediately. This will help us resolve the problem as soon as possible.
(All concerns must be shared in written format — via Email, WhatsApp, or SMS. Verbal communication will not be accepted.)
7. For any other concerns related to our team, please inform us within 2 to 3 days after the event. After this period, DM Creation Photography will not be responsible for any issues related to the shoot or team performance, and no discount or adjustment will be applicable during delivery or final payment.
WORKING HOURS
Working Schedule (Wedding) –
Ring ceremony – 4 to 6 hours (Maximum)/Day
Mehndi/Sangeet- 4 to 6 hours (Maximum)/Day
Marriage – 15 hours (Maximum)/Day
*Gruha Pravesh & Chaturthi Karama puja not included in the package and vidai only from mandap location( Not from client destination)
Reception- 4 to 6 hours (Maximum)/ Day
Pre-wedding- 6 hours/Day
Extra charges for extra hours. Rs 5000/ 1 hour ( Both Wedding & Pre-wedding)
DAMAGE OR DESTRUCTION TO PHOTOGRAPHIC EQUIPMENT
- Due to the camera sensor damage on laser light. The Team is unable to shoot barat procession if the laser light is added on DJ music.
- If the client forced the team to shoot barat procession in the laser light situation on DJ music. The Client will responsible for all camera sensor damage & pay the Camera cost.
- The Drone video Shoot is highly sensitive and restricted. Clients must take permission from the legal authority(Government) in written for drone video shoot.(And Drone Video Shoot Payment can not be refund)
PERMISSIONS & PREREQUISITES FOR DRONE-FLYING FOR YOUR EVENTS
If the venue is inside the Yellow/Red zone, you need clearance from ATC, possibly local authorities (depending on security sensitivity).
Flying in the Red Zone without explicit valid clearance is prohibited and may lead to confiscation of drone + fines / legal penalty.
Unauthorized drone flights near airports / strategic zones can endanger safety of manned aircraft — this is taken very seriously under regulations and may lead to confiscation of drone + fines / legal penalty.
EQUIPMENT QUALITY
The Wedding Photography by DM CREATION PHOTOGRAPHY is committed to use high-quality photography equipments.
MISCONDUCT, NON-PAYMENT & RIGHT TO TERMINATE SERVICES
In the event of any misbehavior, harassment, abuse, intimidation, or non-cooperation by the Client, their family members, guests, or representatives towards DM Creation Photography, its team, its employees, freelancers, or associates at any time during the event, or in the event of failure to make payments strictly as per the agreed schedule, DM Creation Photography shall have the absolute and unconditional right to immediately suspend or terminate the services on the spot without prior notice.
In such circumstances:
- The Photographer shall bear no liability for incomplete coverage or non-delivery of services.
- No refund (full or partial) shall be applicable under any circumstances.
- The Client shall remain liable to clear the full contracted amount, including any outstanding dues.
- DM Creation Photography reserves the right to take appropriate legal action for recovery of dues or damages, if required.
This clause is applicable irrespective of smooth execution of prior events, advance payments already made to the team, or any ongoing services.
